We are pleased to offer 1-800 dial-up service to our customers that travel within the continental United States, but are outside one of our local calling areas.

A surcharge of $4.90 per hour is added to all dial-up calls made to the 800 number. This is in addition to your regular dial-up rates. Calls are billed in 1 second increments, with a 30-second minimum and 20-second set-up time. There is no increase in the surcharge during business hours; the $4.90 per hour surcharge applies to all times.

In order to sign up for MindSpring 1-800 dial-up service, please follow these four easy steps:

  1. Log into MindSpring's Account Management
  2. Select "Enable 800 Service" and agree to the Service Agreement (see Service Agreement below)
  3. We will then activate your 1-800 dial-up service within 24 business hours.
  4. Your 1-800 dial-up service charges will then appear on your MindSpring monthly statement and will show a total dial-up call duration. If you need more information or support, please contact MindSpring.

MindSpring offers optional 800 Service (the 'Service'). The Service will be activated once you agree to the terms below by clicking the accept button below.

A US$4.90 per hour ($0.0816 per minute) surcharge is added to your regular dial-up account charges for all calls using the Service. Calls are billed in 1 minute increments, with a 30 second minimum.

*** Please understand that the Service is not a free service. ***

  1. Dial-Up Service Agreement. I acknowledge that I agreed to the MindSpring Dial-Up Service Agreement when I established my internet access account and/or web site hosting services account. I agree that this Agreement for the Service supplements the Dial-Up Service Agreement.
  2. Provision of the Service. I understand and agree that, subject to the terms and conditions of this Agreement, MindSpring shall provide me access to the Service. I understand and agree that I am fully responsible for the use of the Service by me or by anyone whom I permit to use my account, and that MindSpring reserves the right to terminate the Service at any time, for any or no reason.
  3. Payment Obligations. I understand that MindSpring will bill charges for the Service to my MindSpring account each month for my use of the Service, if any. I understand that these charges may appear on my regular bill for my account dial-up service.
  4. My Obligations. I understand that I am responsible for any telecommunications charges I may incur in using the Service. These charges may include, without limitation, local telephone company charges, hotel access fees, and long distance charges. I understand that I may cancel this Service at any time effective the end of that billing cycle. I understand that MindSpring may change its prices for the Service from time to time, and that I will be provided with 15 days written or electronic mail notice of any such changes.
  5. Appropriate Use of Services. I agree to abide at all times by MindSpring's then-current Appropriate Use Policy as made available on the MindSpring home page at http://www.mindspring.net/aboutms/policy.html and by any other policies posted on the MindSpring web site.
  6. Warranty Disclaimer. I understand that the use of the Service will be completely at my own risk. MindSpring makes no warranties of any kind, whether expressed, implied, or statutory concerning the Service. I understand that the cumulative liability of MindSpring for any and all claims relating to the Service provided by MindSpring, in contract, tort, or otherwise, shall not exceed that total amount of the fees which I paid to MindSpring for the Service within the prior year. I AGREE THAT MINDSPRING SHALL HAVE NO LIABILITY FOR ANY CONSEQUENTIAL, INDIRECT, SPECIAL OR INCIDENTAL DAMAGES REGARDLESS OF THE SUCCESS OR EFFECTIVENESS OF OTHER REMEDIES.
  7. Indemnification. I agree to defend, indemnify and hold MindSpring and its affiliates harmless from any and all liabilities, costs, and expenses, including reasonable attorneys' fees, related to or arising from, any violation of this Agreement by me or those who access the Service through my account, or the use of the Service or the Internet and the placement or transmission of any message, information, software, audio files or other materials on the Internet by me or by those who have access to the Service through my account.
  8. Termination. I understand that MindSpring reserves the right to terminate the Service at any time, for any or no reason, including, but not limited to, my failure to abide by the terms of this Agreement or my failure to pay any fees or charges when due. If the Service is inactivated, I may be required to pay reconnect charges and a prepaid deposit in order to re-activate the Service.
  9. Law and Jurisdiction. I understand and agree the laws of the State of Georgia govern this Agreement. I expressly agree that exclusive jurisdiction for any claim or dispute with MindSpring or relating in any way to the Service resides in the courts of Georgia. I further agree and expressly consent to the exercise of personal jurisdiction in the courts of Georgia in onnection with any such dispute, including any claim involving MindSpring or its affiliates, subsidiaries, employees, contractors, officers, or directors.
  10. Complete Agreement: Amendments. This Agreement represents the complete agreement between MindSpring and me with respect to the Service, and supersedes any other written or oral agreement. I understand and agree that MindSpring may amend or modify this Agreement or impose new conditions at any time. Any use of the Service shall be deemed to constitute acceptance by me of the then-current Service Agreement (including any amendments, modifications or new conditions) as published and made available on the MindSpring home page at http://www.mindspring.net/prod-svc/800.html.
